Apple Will Face Class-Action Lawsuit Over AirTag Safety

Apple lost its bid to dismiss a lawsuit involving its AirTags Friday and will now have to face a class action lawsuit that alleges the devices helped stalkers track their victims.According to Bloomberg, US District Judge Vince Chhabria in San Francisco ruled that the plaintiffs in the case had done a sufficient job of proving their claims against Apple for negligence and product liability; however, he dismissed other claims made by the group.The plaintiffs in the case claim that Apple had been warned about the dangers that AirTags posed and that the company is liable when the devices are used for misconduct. They claim that they were stalked using the devices and that problems with the AirTag’s safety features are responsible for their injuries. The group says that at its $29 price tag, the AirTag has “become the weapon of choice of stalkers and abusers.”Apple has argued it is not responsible for how the AirTags are used. The company has; however, developed a feature that lets a user know when AirTag might be tracking their location.In iOS 15.4 the company also added an alert when a user is setting up an AirTag for the first time that explains that AirTags are meant to track personal property and that “using an AirTag to track people without consent is a crime in many regions of the world.”

In addition to tracking people, AirTags have also been used by car thieves to follow potential marks. Inversely, Washington D.C. has issued the devices to some residents as a way to help them track down stolen vehicles faster. The devices have also been used successfully several times to track down stolen luggage.Apple isn’t the only company whose devices are being accused of being used to assist stalked. Tile is facing a similar lawsuit now regarding its tracking device’s lack of protection against stalking.
